N\u00eb teori, ajo krijon balanc\u00eb n\u00eb marr\u00ebdh\u00ebniet e pabarabarta mes pun\u00ebtor\u00ebve dhe pun\u00ebdh\u00ebn\u00ebsve, siguron negociim kolektiv dhe sh\u00ebrben si kanal institucional p\u00ebr p\u00ebrfshirjen e pun\u00ebtor\u00ebve n\u00eb vendimmarrjen socio-ekonomike. N\u00eb Kosov\u00eb, kjo e drejt\u00eb \u00ebsht\u00eb e garantuar me ligj dhe \u00ebsht\u00eb pjes\u00eb e narrativ\u00ebs zyrtare p\u00ebr nd\u00ebrtimin e nj\u00eb tregu pune t\u00eb p\u00ebrputhur me standardet nd\u00ebrkomb\u00ebtare dhe aspiratat evropiane t\u00eb vendit.<\/p><p style=\"font-weight: 400;\">Megjithat\u00eb, p\u00ebrtej k\u00ebtij garantimi formal, organizimi sindikal n\u00eb praktik\u00eb mbetet i dob\u00ebt, i fragmentuar dhe i kufizuar n\u00eb nj\u00eb pjes\u00eb shum\u00eb t\u00eb vog\u00ebl t\u00eb tregut t\u00eb pun\u00ebs. Sindikatat ekzistojn\u00eb kryesisht n\u00eb sektorin publik dhe n\u00eb disa nd\u00ebrmarrje t\u00eb m\u00ebdha, nd\u00ebrsa p\u00ebr shumic\u00ebn e pun\u00ebtor\u00ebve n\u00eb sektorin privat, organizimi kolektiv \u00ebsht\u00eb i paarritsh\u00ebm. Kjo mosp\u00ebrputhje mes ligjit dhe realitetit nuk \u00ebsht\u00eb pasoj\u00eb e munges\u00ebs s\u00eb interesit t\u00eb pun\u00ebtor\u00ebve, por rezultat i drejtp\u00ebrdrejt\u00eb i nj\u00eb dizajni ligjor dhe institucional q\u00eb nuk reflekton struktur\u00ebn reale t\u00eb ekonomis\u00eb kosovare.<\/p><h4 style=\"font-weight: 400;\"><strong>Dialog social pa shumic\u00ebn e pun\u00ebtor\u00ebve<\/strong><\/h4><p style=\"font-weight: 400;\"><strong>Kur p\u00ebrfaq\u00ebsimi mbetet formal<\/strong><\/p><p style=\"font-weight: 400;\">Dialogu social n\u00eb Kosov\u00eb institucionalizohet p\u00ebrmes Ligjit Nr. 04\/L-074 p\u00ebr K\u00ebshillin Ekonomik-Social, i cili synon t\u00eb krijoj\u00eb nj\u00eb mekaniz\u00ebm konsultativ trepal\u00ebsh mes qeveris\u00eb, pun\u00ebdh\u00ebn\u00ebsve dhe p\u00ebrfaq\u00ebsuesve t\u00eb pun\u00ebtor\u00ebve. N\u00eb parim, ky mekaniz\u00ebm duhet t\u00eb sh\u00ebrbej\u00eb si hap\u00ebsir\u00eb p\u00ebr diskutim, koordinim dhe ndikim t\u00eb p\u00ebrbashk\u00ebt n\u00eb politikat ekonomike, sociale dhe t\u00eb pun\u00ebs.<\/p><p style=\"font-weight: 400;\">N\u00eb praktik\u00eb, megjithat\u00eb, dialogu social mbetet kryesisht simbolik. K\u00ebshilli Ekonomik-Social ka rol konsultativ dhe ligji nuk parashikon detyrime juridikisht t\u00eb zbatueshme p\u00ebr institucionet publike lidhur me rezultatet e dialogut. Mendimet dhe rekomandimet e tij nuk jan\u00eb obliguese dhe nuk shoq\u00ebrohen me mekanizma q\u00eb do t\u00eb garantonin integrimin e tyre n\u00eb politikat p\u00ebrfundimtare. Si rezultat, vendimet ky\u00e7e mbi pag\u00ebn minimale, reformat e ligjit t\u00eb pun\u00ebs apo masat sociale miratohen shpesh pa konsensus t\u00eb gjer\u00eb dhe pa reflektuar realisht interesat e pun\u00ebtor\u00ebve.<\/p><p style=\"font-weight: 400;\">Kjo dob\u00ebsi strukturore e dialogut social lidhet drejtp\u00ebrdrejt me p\u00ebrfaq\u00ebsimin sindikal. P\u00ebrfaq\u00ebsimi i pun\u00ebtor\u00ebve n\u00eb K\u00ebshillin Ekonomik-Social bazohet n\u00eb struktura sindikale q\u00eb vet\u00eb jan\u00eb t\u00eb dob\u00ebta dhe t\u00eb p\u00ebrqendruara kryesisht n\u00eb sektorin publik. Pun\u00ebtor\u00ebt n\u00eb sektorin privat, n\u00eb ekonomi informale dhe n\u00eb bizneset e vogla dhe t\u00eb mesme mbeten jasht\u00eb k\u00ebtij dialogu. Si pasoj\u00eb, dialogu social n\u00eb Kosov\u00eb nuk pasqyron realitetin e shumic\u00ebs s\u00eb fuqis\u00eb pun\u00ebtore, por vet\u00ebm interesat e nj\u00eb segmenti t\u00eb kufizuar t\u00eb saj.<\/p><h4 style=\"font-weight: 400;\"><strong>Ekonomia reale dhe iluzioni i ligjit neutral<\/strong><\/h4><p style=\"font-weight: 400;\"><strong>95 p\u00ebr qind biznese t\u00eb vogla, informalitet i lart\u00eb<\/strong><\/p><p style=\"font-weight: 400;\">Struktura e ekonomis\u00eb kosovare \u00ebsht\u00eb nj\u00eb faktor ky\u00e7 p\u00ebr t\u00eb kuptuar pse organizimi sindikal nuk po funksionon n\u00eb praktik\u00eb. Rreth 95 p\u00ebr qind e bizneseve n\u00eb Kosov\u00eb jan\u00eb t\u00eb vogla dhe t\u00eb mesme, shumica prej tyre me pak pun\u00ebtor\u00eb, marr\u00ebdh\u00ebnie pune t\u00eb paq\u00ebndrueshme dhe nivel t\u00eb lart\u00eb informaliteti. N\u00eb shum\u00eb sektor\u00eb, pun\u00ebsimi zhvillohet p\u00ebrmes kontratave afatshkurtra, pun\u00ebs s\u00eb padeklaruar ose formave t\u00eb tjera fleksibile q\u00eb e rrisin pasigurin\u00eb ekonomike t\u00eb pun\u00ebtor\u00ebve.<\/p><p style=\"font-weight: 400;\">N\u00eb k\u00ebt\u00eb kontekst, marr\u00ebdh\u00ebniet e pun\u00ebs jan\u00eb t\u00eb personalizuara dhe t\u00eb pabalancuara. Pun\u00ebtor\u00ebt varen drejtp\u00ebrdrejt nga pun\u00ebdh\u00ebn\u00ebsi dhe \u00e7do tentativ\u00eb p\u00ebr organizim kolektiv perceptohet si rrezik personal. Frika nga humbja e vendit t\u00eb pun\u00ebs, nga mosrinovimi i kontrat\u00ebs apo nga margjinalizimi profesional \u00ebsht\u00eb reale, ve\u00e7an\u00ebrisht n\u00eb munges\u00eb t\u00eb mbrojtjes efektive institucionale kund\u00ebr diskriminimit sindikal.<\/p><p style=\"font-weight: 400;\">Megjithat\u00eb, ligji p\u00ebr organizimin sindikal vazhdon t\u00eb operoj\u00eb mbi supozimin e nd\u00ebrmarrjeve t\u00eb m\u00ebdha dhe marr\u00ebdh\u00ebnieve t\u00eb q\u00ebndrueshme t\u00eb pun\u00ebs. Ky mosp\u00ebrputhje mes ligjit formal dhe ekonomis\u00eb reale krijon nj\u00eb hendek strukturor, ku e drejta p\u00ebr organizim ekziston n\u00eb let\u00ebr, por nuk \u00ebsht\u00eb e dizajnuar p\u00ebr realitetin n\u00eb t\u00eb cilin punojn\u00eb shumica e pun\u00ebtor\u00ebve.<\/p><h4 style=\"font-weight: 400;\"><strong>Kuota q\u00eb e b\u00ebn t\u00eb drejt\u00ebn privilegj<\/strong><\/h4><p style=\"font-weight: 400;\">Dhjet\u00eb pun\u00ebtor\u00eb p\u00ebr nj\u00eb ekonomi q\u00eb nuk i ka<\/p><p style=\"font-weight: 400;\">Nj\u00eb nga pengesat m\u00eb t\u00eb qarta ligjore p\u00ebr organizimin sindikal n\u00eb Kosov\u00eb \u00ebsht\u00eb kriteri p\u00ebr numrin minimal t\u00eb an\u00ebtar\u00ebve p\u00ebr themelimin e nj\u00eb shoqate sindikale. Ligji p\u00ebr Sindikatat k\u00ebrkon q\u00eb nj\u00eb sindikat\u00eb t\u00eb themelohet nga s\u00eb paku dhjet\u00eb pun\u00ebtor\u00eb n\u00eb pozita jo-menaxheriale. Ky kriter, i menduar si kusht teknik p\u00ebr funksionalitet, n\u00eb praktik\u00eb shnd\u00ebrrohet n\u00eb nj\u00eb mekaniz\u00ebm p\u00ebrjashtues.<\/p><p style=\"font-weight: 400;\">N\u00eb shumic\u00ebn e bizneseve private, ky num\u00ebr nuk ekziston. Edhe n\u00eb rastet kur ekziston, k\u00ebrkesa q\u00eb dhjet\u00eb pun\u00ebtor\u00eb t\u00eb identifikohen publikisht si themelues i ekspozon ata ndaj presioneve dhe nd\u00ebshkimeve, n\u00eb nj\u00eb sistem ku mbrojtja kund\u00ebr diskriminimit sindikal \u00ebsht\u00eb e dob\u00ebt dhe joefektive. Si pasoj\u00eb, pun\u00ebtor\u00ebt hezitojn\u00eb t\u00eb organizohen dhe organizimi sindikal mbetet privilegj i sektorit publik dhe i nd\u00ebrmarrjeve t\u00eb m\u00ebdha.<\/p><p style=\"font-weight: 400;\">Ky kriter ligjor nuk \u00ebsht\u00eb neutral. Ai prodhon pabarazi strukturore n\u00eb p\u00ebrfaq\u00ebsim dhe e zhvendos barr\u00ebn e organizimit tek individ\u00ebt m\u00eb t\u00eb ekspozuar, pa u ofruar atyre mbrojtje reale. E drejta p\u00ebr organizim sindikal ekziston, por vet\u00ebm p\u00ebr ata q\u00eb tashm\u00eb jan\u00eb n\u00eb pozita m\u00eb t\u00eb sigurta t\u00eb tregut t\u00eb pun\u00ebs.<\/p><h4 style=\"font-weight: 400;\"><strong>\u00c7far\u00eb tregojn\u00eb praktikat krahasuese<\/strong><\/h4><p style=\"font-weight: 400;\">Kur ligji i p\u00ebrshtatet ekonomis\u00eb, jo e kund\u00ebrta<\/p><p style=\"font-weight: 400;\">Praktikat krahasuese n\u00eb rajon dhe n\u00eb Bashkimin Evropian tregojn\u00eb se organizimi sindikal nuk nd\u00ebrtohet p\u00ebrmes pragjeve t\u00eb larta numerike, por p\u00ebrmes leht\u00ebsimit t\u00eb ushtrimit t\u00eb s\u00eb drejt\u00ebs dhe mbrojtjes efektive t\u00eb veprimtaris\u00eb sindikale. N\u00eb shum\u00eb vende, legjislacionet jan\u00eb m\u00eb fleksibile dhe njohin forma sektoriale, nd\u00ebrnd\u00ebrmarr\u00ebse dhe rajonale t\u00eb organizimit, duke u mund\u00ebsuar pun\u00ebtor\u00ebve nga nd\u00ebrmarrje t\u00eb vogla t\u00eb bashkohen pa u ekspozuar individualisht.<\/p><p style=\"font-weight: 400;\">Standardet e Organizat\u00ebs Nd\u00ebrkomb\u00ebtare t\u00eb Pun\u00ebs theksojn\u00eb se \u00e7do kufizim mbi t\u00eb drejt\u00ebn e organizimit duhet t\u00eb jet\u00eb proporcional dhe t\u00eb mos ket\u00eb efekt p\u00ebrjashtues. N\u00eb k\u00ebt\u00eb perspektiv\u00eb, kuota fikse prej dhjet\u00eb an\u00ebtar\u00ebsh n\u00eb Kosov\u00eb del si e pap\u00ebrshtatur me realitetin ekonomik dhe si nj\u00eb penges\u00eb strukturore p\u00ebr p\u00ebrfaq\u00ebsim kolektiv.<\/p><h4 style=\"font-weight: 400;\"><strong>Nga garantim formal n\u00eb p\u00ebrjashtim real<\/strong><\/h4><p style=\"font-weight: 400;\">Kur ligji prodhon pabarazi<\/p><p style=\"font-weight: 400;\">N\u00eb k\u00ebt\u00eb situat\u00eb, organizimi sindikal n\u00eb Kosov\u00eb nuk d\u00ebshton p\u00ebr munges\u00eb vullneti t\u00eb pun\u00ebtor\u00ebve, por sepse sistemi ligjor dhe institucional nuk \u00ebsht\u00eb nd\u00ebrtuar p\u00ebr realitetin e ekonomis\u00eb kosovare. Ligjet presupozojn\u00eb stabilitet q\u00eb nuk ekziston, nd\u00ebrsa dialogu social nd\u00ebrtohet mbi nj\u00eb baz\u00eb p\u00ebrfaq\u00ebsimi t\u00eb ngusht\u00eb. Si rezultat, politikat e pun\u00ebs zhvillohen pa pjes\u00ebmarrjen reale t\u00eb shumic\u00ebs s\u00eb pun\u00ebtor\u00ebve dhe pa reflektuar p\u00ebrvoj\u00ebn e tyre t\u00eb p\u00ebrditshme.<\/p><h4 style=\"font-weight: 400;\"><strong>P\u00ebrfundim<\/strong><\/h4><p style=\"font-weight: 400;\">N\u00eb nj\u00eb ekonomi ku 95 p\u00ebr qind e bizneseve jan\u00eb t\u00eb vogla dhe informaliteti \u00ebsht\u00eb norm\u00eb, mbajtja n\u00eb fuqi e rregullave ligjore q\u00eb e b\u00ebjn\u00eb organizimin sindikal t\u00eb paarritsh\u00ebm p\u00ebr shumic\u00ebn e pun\u00ebtor\u00ebve nuk \u00ebsht\u00eb rast\u00ebsi dhe as neutralitet ligjor. \u00cbsht\u00eb zgjedhje politike. Kuvendi dhe Qeveria e Kosov\u00ebs nuk mund t\u00eb vazhdojn\u00eb t\u00eb flasin p\u00ebr dialog social, nd\u00ebrkoh\u00eb q\u00eb ruajn\u00eb kritere q\u00eb p\u00ebrjashtojn\u00eb shumic\u00ebn e fuqis\u00eb pun\u00ebtore nga p\u00ebrfaq\u00ebsimi kolektiv. Pa reform\u00eb reale t\u00eb Ligjit p\u00ebr Sindikatat, pa rishikim t\u00eb kuot\u00ebs minimale prej dhjet\u00eb an\u00ebtar\u00ebsh dhe pa forcim substancial t\u00eb rolit t\u00eb Ligjit Nr. 04\/L-074 p\u00ebr K\u00ebshillin Ekonomik-Social, dialogu social do t\u00eb mbetet dekor institucional, nd\u00ebrsa politikat e pun\u00ebs do t\u00eb vazhdojn\u00eb t\u00eb hartohen pa ata q\u00eb e mbajn\u00eb ekonomin\u00eb n\u00eb k\u00ebmb\u00eb.
