This research paper is one of the activities implemented under the ‘’SpeakUp’ project, by Iniciativa Kosovare per Stabilitet, funded by Solidar Suisse Kosova.

IKS intends to commission a research company/local expert to undertake a comparative research study with the objective of contributing to the study of “SpeakUp” project. IKS will coordinate this effort, but the research expert would be responsible for organizing and conducting research and providing thoroughgoing analysis and findings. IKS reserves the right to review and approve the methodology and all instruments, guides, and or administrative procedures as necessary to comply with IKS procedures.

Consultant submitting proposals are invited to demonstrate their capability and credentials to offer these services (e.g. past experience in the field), set out their proposed methodological approach and quote a price for the services requested.

The intended commencement period is 23th of February 2022 and the period of execution of the contract will be 45 days from this date. The fieldwork should be completed before the th 10th of April 2023.

Terms of Reference for Annual Audit of Project/Programme Support including ISRS 4400

Iniciativa Kosovare për Stabilitet (IKS) hereafter referred to as the “Cooperation partner” wishes to engage the services of an audit firm for the purpose of auditing the Human Rightivism, as stipulated in the agreement between the Cooperation partner and Sida. The audit shall be carried out in accordance with international audit standards (ISA) issued by IAASB1. In addition, an assignment according to International Standards on Related Services (ISRS) 4400 shall be carried out. The audit and the additional assignment shall be carried out by an external, independent and qualified auditor.

Improving employment conditions is a key element in working towards better law implementation in Kosovo. Through this contract, the IKS project team aim to obtain information about the situation and quality of jobs for employees in Kosovo and feed information on the working conditions at the country level in all sectors. This will be used by Ministry of Finance, Labour and Transfers as the basis for a policy/work strategy and a wider programme to support labor law implementation in Kosovo.

Terms of Reference – Project Assistant/Intern

Scope and Methodology 

IKS intends to hire a part-time Project Assistant/Intern. 

The tasks and responsibilities of the Project Assistant/Intern are to: 

1. Support the Project Manager/Executive Director; 

2. Support to day-to-day management of the “Support to Social Justice Coalition” project; 

3. To ensure the project is delivered within the timeframe and budget; 

4. Keep track of activity plan; 

5. Support on preparing administrative and financial records in close cooperation with the Project management and Finance team; 

6. Support on preparing project contracts and donor reports. 

Duration of the assignment 

The intended duration is six (6) months up to one (1) year of paid internship.

Terms of Reference – Matra

Objectives

Improving employment conditions is a key element in working towards better gender equality in Kosovo.Through this contract, the IKS project team aim to obtain information about the quality of jobs for women in Kosovo and feed information on the working conditions of women at the country level in the retail and cleaning industry. This will be used by IKS and QPA as the basis for a policy/work strategy and a wider programme of support to women participation in the labor market in Kosovo.

While the focus of CSOs and other actors has rightly been on active labour market projects, decent work has been neglected to date. Regardless of which factor is the most prevalent, it is certain that discrimination of women at workplace happens systematically and their working conditions are far from being decent.

Our goal is to achieve decent work conditions for all women. Ending this form of discrimination against women and girls is not only a basic human right, but it is also crucial to achieving social justice.

Implementation

The intended commencement period is the 1st of October 2021, while the sessions should be completed before the 31st of December 2021.

Terms of Reference

Conflict Mitigation and Mediation Services Expert

The implementation of labour-related laws is quite poor in Kosovo and subject to grave criticism. One basic problem of its implementation is the general situation in the field, particularly the high unemployment rate, which causes employees to remain in their positions regardless of the working condition, despite breaches of their rights. An additional obstacle to the implementation of labour related legislation has been the lack of implementing and monitoring capacities of responsible institutions. 

Scope and Methodology

IKS intends to commission a local Conflict Mitigation and Mediation Services Expert for offering training for Resolution- ADR to BSPK members. IKS and BSPK will coordinate this effort, but the expert would be responsible for organizing trainings and communicate with lawyers from federations. IKS reserves the right to review and approve the methodology and all instruments, guides, and or administrative procedures as necessary to comply with IKS procedures. 

Through this activity, there are several steps that the expert need to do: 

1. Provide trade union members training programmes for resolving cases on violations of labour and OSH Law 

2. Promote the resolution of conflict through mediation and other dispute resolution practices; 

3. Support the expansion and adoption of mediation and dispute resolution in labour related cases;

Terms of Reference

Conduct annual survey with businesses across Kosovo to monitor the implementation of labor related legislation in Kosovo.

IKS is  implementing the “Support to Social Justice Coalition”  project funded by the UNOPS. The Overall Objective of the Project is to contribute to greater social justice by improving implementation of labour rights and labour-related legislation through enabling active engagement of civil society and social partners. A greater social justice would contribute to better distribution of opportunities, wealth and privileges in the society. This would directly enhance the condition in the labour market for all workers and especially the more vulnerable groups: women and formally and informally employed in the private sector, as the least protected categories in the labour market at risk of being poor.

RESEARCH PURPOSE AND OBJECTIVES

The purpose of this research is to assess the current situation in the private sector in Kosovo about the labor rights and health and safety working conditions. The survey results will be presented to stakeholders and serve for improving the legislation and/or implementation of existing legal base.

The call will be open for a week, starting from 21th of May 2021.

Expression of Interest

Mentoring and coaching the leaders to potentially establish trade union is one of the activities implemented under the ‘Decent Jobs for Women’ project, by Kosovar Stability Initiative and Centre for Policy and Advocacy, funded by the Embassy of Netherlands in Kosovo. With only around 18% of women employed in the formal economy (World Bank, 2019), employment of women in Kosovo is one of the lowest in the world and lower than other Western Balkan countries. The lack of appropriate investigative journalism on these matters coupled with lack of political will of the state to protect the workers’ rights has left women alone in their extremely difficult employment situation. It is assessed that women working in the retail and cleaning industry are the ones suffering most. Although the Law 04/L011 on Organizing in Trade Unions in Kosovo does exist, the workers in the Private Sector do not realize their right to organize, allegedly in fear of being persecuted or fired by the employer. While the focus of CSOs and other actors has, rightly, been on active labor market projects, decent work has been neglected to date. Women and employment, even without the discrimination at workplace is still a challenging area. Existing studies show that women are in an underprivileged position compared to men not only when it comes to employment participation rate but also types of occupation, and income in both private and public sector.
